These Terms of Service (“Terms”) apply to everything you buy or download on flextrik.com (the “Site”). By placing an order or creating an account you agree to them. If you do not agree, please do not use the Site. In these Terms, “FLEXTRIK”, “we” and “us” mean the seller of the products on this Site; “you” means the buyer.
1. What we sell
We sell digital files: drum kits and sample packs, Serum preset banks, FL Studio vocal presets, and licenses for the SHROOMDECK VST plugin (together, the “Products”), and custom work made by hand: a custom voice tag and the mixing of your track (the “Services”, see section 5). Everything is delivered as files; nothing is shipped physically. The description, contents and price of each Product are shown on its card on the Site. We may change or remove Products and prices at any time; a change never affects an order you have already paid for.
2. License to use the Products
When your payment is confirmed you receive a personal, non-exclusive, non-transferable license to use the Product in your own music productions, including commercial releases, unless the Product page says otherwise. You may not resell, share, upload, sub-license or otherwise redistribute the Product files, in whole or in part, as samples, presets or a pack, and you may not claim them as your own. The plugin license is tied to your devices: a Personal license covers one device and a Commercial license covers the number of devices shown on its card. You keep ownership of the music you make; we keep ownership of the Products.
3. Orders and payment
All prices are shown in US dollars. At checkout you choose a payment method (PayPal, USDT on the TRC20 network, or a Ukrainian or Russian bank card / SBP transfer) and the exact amount to pay is shown in that method’s currency. You pay by transferring that exact amount and then upload a proof of payment (a screenshot or receipt, or the transaction hash for USDT). Payments are checked by a person, usually within a few hours and at most within 24 hours. Your order is confirmed only when we have checked your payment; until then you have not bought anything and no files are released. An unpaid order expires after 24 hours. You are responsible for the transfer fees of your bank or payment provider, and for sending the exact amount to the exact address shown.
4. Delivery
After your payment is confirmed we send an e-mail with a personal download link to the address of your account, and the same files appear in your account on the Site. Download links are personal: do not share them. If you did not receive the e-mail, check your spam folder and your account, or contact us. Each copy of a Product can contain an invisible identifier connected to your purchase, so that unauthorised redistribution can be traced.
5. Custom services (voice tags and mixing)
A voice tag is a short audio tag made for you from the application you fill in before you pay: the voice (male or female), the phrase and the effects you want. A mix is the mixing of your track from the dry vocal tracks and the beat that you send us after you pay, as one .zip archive (up to 95 MB) or as a download link. You pay for a Service like any other order (section 3), and we start when the payment is confirmed (and, for a mix, when your files arrive).
We aim to deliver a voice tag within 24 hours of the confirmed payment and a mix within 72 hours of receiving usable files. These times are targets, not guarantees. Each Service includes up to two revisions: after delivery you can accept the result or ask, in writing, for a change, up to two times. A revision is a correction of what you asked for, not a new brief. We may ask you to resend files that are damaged, incomplete or not what the order needs.
You confirm that you own, or have permission to use, everything you send us, and that it contains nothing unlawful. We use your files only to do the work: only the people working on your order see them, and we do not publish, share or sell them. You may use the result in your own music, including commercial releases. The result and the files you uploaded stay on the Site for 60 days after delivery and are then deleted, so please download and keep your copy.
6. Your account
You sign in with your e-mail address and a one-time code. You are responsible for keeping access to your e-mail account secure and for everything done through your account. Tell us at once if you think someone else has used it.
7. Acceptable use
Do not attempt to break, scan or overload the Site; do not use automated tools to create orders or accounts; do not upload forged or edited proofs of payment; do not use the Site for anything unlawful. We may refuse an order, close an account or withhold files if we reasonably suspect fraud, a forged proof of payment, or a breach of these Terms. If you leak or resell the Products we may end your license without refund and take legal action.
8. Refunds
Refunds are governed by our Refund Policy, which is part of these Terms.
9. Our liability
The Products and the Services are provided “as is”. We do our best to make them work with the software they are made for (the sounds work in any DAW; Serum presets need Xfer Serum; FL Studio presets need FL Studio; the plugin runs as VST3, and as AU on macOS), but we do not promise that they fit your particular needs or that they will work without interruption on every system. To the extent the law allows, our total liability for any claim connected with a Product or a Service is limited to the price you paid for it, and we are not liable for indirect or consequential losses such as lost income or lost projects. Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer that cannot be waived.
10. Third-party names
Serum is a product of Xfer Records, FL Studio is a product of Image-Line, PayPal is a trademark of PayPal, Inc., Telegram is a product of Telegram FZ-LLC. We are not affiliated with or endorsed by them; the names are used only to say what our Products work with and how you can pay.
11. Changes to these Terms
We may update these Terms. The version published on the Site on the day of your order applies to that order. The date at the top shows when they were last changed.
